Overview
Futureville, LLC ("Company", "we", "us"), the operator of CUNinjas at cuninjas.com (the "Service"), respects the intellectual-property rights of others. The Service hosts content posted by members and links out to third-party publisher articles. If you believe content on the Service infringes your copyright, you may send us a notice as described below, and we will respond to valid notices consistent with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
How to Submit a Notice of Claimed Infringement
To report content you believe infringes your copyright, send a written notice to our Designated Agent (below) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):
- a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
- identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
- identification of the material that is claimed to be infringing and that you want removed, with enough information to let us locate it (for example, the URL or page on the Service);
- your contact information, including your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
Please note that under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages.
Designated Agent
Send DMCA notices to our Designated Agent:
- Futureville, LLC
- Attn: DMCA Agent
- Email: dmca@cuninjas.com
- Mailing address: 26992 Cox Drive, Mechanicsville, MD 20659
Designation and registration of a DMCA agent with the U.S. Copyright Office is required to claim the DMCA's safe-harbor protections. That registration is currently [pending / being completed]. We will still review and act on valid notices in the meantime.
Counter-Notification
If your content was removed or disabled and you believe this was a mistake or misidentification, you may send a counter-notification to our Designated Agent that includes all of the following, as required by 17 U.S.C. § 512(g):
- your physical or electronic signature;
- identification of the material that was removed or disabled and the location where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.
Upon receiving a valid counter-notification, we will promptly forward a copy to the person who submitted the original notice and inform them that we will restore the removed material in 10–14 business days. We may then restore the material in 10–14 business days unless the original complainant first notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
Repeat Infringer Policy
We may, in appropriate circumstances and at our discretion, disable or terminate the accounts of members who are determined to be repeat infringers.
Note on the Newsfeed
The CUNinjas newsfeed links out to third-party publisher articles and displays only a headline, the source name, and the publication date. It does not host article images or article bodies. If you nonetheless believe a newsfeed item infringes your copyright, you may submit a notice as described above and we will review it.
